Terms of Service & Privacy Policy

Terms of Service
1. Our agreement
These terms are between you and Avoxa, based in United States. Contact hello@avoxa.app for service or legal questions. By creating an account or using the service, you agree to these terms. If you act for an organization, you must have authority to bind it. You must be 18 or older. A separately signed agreement controls where it conflicts with these terms.
2. Accounts and permitted use
Keep access secure and provide accurate account information. You may test only systems, phone numbers and data you are authorized to test. You are responsible for obtaining required permissions and notices for calls, recordings, personal data, third-party endpoints and load tests. Do not use Avoxa to spam, harass, violate privacy or law, bypass security, attack unrelated systems or exceed agreed limits. Do not rely on an automated evaluation as the sole basis for a safety-critical or legally significant decision.
3. Your content and AI outputs
You retain your rights in your content. You grant us permission to host, transmit and process it only as needed to provide/support the service, secure it and meet legal obligations. You must have the necessary rights to submit it. AI-generated scenarios, speech and evaluations may be inaccurate, incomplete or non-unique. Review outputs and verify findings before acting. A passing test is not a certification, legal opinion or guarantee of production behavior.
4. Early access, payment and cancellation
Avoxa currently offers an early-access waitlist; the website has no online checkout. Joining the waitlist does not create a paid subscription. Access, features and limits may change during early access.
If you enter a paid order with us, that order must disclose the price, currency, taxes, billing period and renewal/cancellation terms before payment. Cancel future renewals at any time using the cancellation method in your order or by contacting hello@avoxa.app; cancellation takes effect for future billing as described in the order. Refund requests are reviewed individually. Email hello@avoxa.app with your account email, order or invoice reference, payment date and reason. Do not send full card numbers or security codes. If approved, refunds are arranged through the original payment method where possible; bank processing times vary. Cancellation does not automatically refund an already completed billing period. Mandatory consumer rights remain unaffected.
5. Availability and termination
We use reasonable care to operate the service, but do not promise uninterrupted availability or that it will identify every defect. We may restrict or suspend use for a material breach, security risk, legal requirement or nonpayment, with notice when practicable. You may stop using the service and delete your account. Account deletion also removes your personally owned workspace and may remove access for its members; cancel any separate paid order as well.
6. Disclaimer of warranties
To the extent permitted by law, the service and outputs are provided as available, without implied warranties of merchantability, fitness for a particular purpose or non-infringement. No disclaimer removes a warranty, consumer guarantee or remedy that the law does not allow us to exclude.
7. Limits on liability
To the extent permitted by law, neither party is liable to the other for indirect, incidental, special or consequential losses, lost profits or lost business opportunity arising from the service. Our total aggregate liability arising from these terms or the service is limited to the greater of US$100 and the fees you paid us for the affected service during the 12 months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or statutory right that cannot legally be limited. Mandatory rights take precedence.
8. Privacy, changes and disputes
Our privacy policy explains data processing; a data-processing agreement may be required for customer-controlled personal data. We will communicate material term changes with reasonable notice where practicable. Changes apply prospectively; a paid order is not retroactively rewritten by a website update.
Contact hello@avoxa.app first so we can try to resolve a dispute. These terms do not impose mandatory arbitration or waive class-action or consumer rights. Applicable law determines governing law and venue unless a separately signed order lawfully specifies otherwise.
Privacy Policy
1. Who is responsible
This policy covers avoxa.app and the Avoxa dashboard/API. The operator is Avoxa, based in United States. Contact hello@avoxa.app for privacy requests.
We are the controller for account, website and business-contact data. For test content a business customer uploads or directs us to process, we generally act on that customer’s instructions. That customer remains responsible for its own notices, lawful basis, call-recording permissions and recipients.
2. Data we collect
- Account details: email, name, optional company/job title, settings, team membership and sign-in/session records.
- Test content: agent endpoints, phone numbers, scenarios, test-customer facts, uploaded reference material, prompts, transcripts, recordings, results, issue notes and webhook configuration.
- Technical data: IP address, user agent, request times, URLs, authentication/security events and error/delivery logs.
- Messages you send to hello@avoxa.app, including legal, privacy and refund requests.
3. How and why we use data
We use account and test data to provide the service, authenticate access, run requested tests, deliver results and notifications, support customers and manage business requests. Where EU/UK data-protection law applies, performance of a contract is our basis for providing an account/service; legitimate interests cover proportionate security, fraud prevention, support and service reliability; legal obligations cover records we are required to keep. Optional marketing or optional tracking would require a separate appropriate basis or consent before activation.
AI model and speech providers receive the inputs needed for the requested tasks. Avoid uploading live passwords, API secrets, sensitive personal data or production customer data unless necessary and authorized. AI-generated output can be inaccurate.
4. AI testing and voice processing
Avoxa uses AI to generate test scenarios, simulate conversations, transcribe audio and evaluate results. Test instructions, relevant reference content, conversation text and audio are processed by the model, speech and telephone services needed to run your tests. Workspace-selected agent systems and webhooks receive the inputs or results you direct us to send. Only submit personal data you are authorized to use for these tests. Do not include production secrets or sensitive information unless necessary and lawfully authorized.
5. Sharing personal information
We use service providers for hosting, private storage, transactional email, voice and telephone connectivity, and AI processing. They receive the account, technical or test data needed to perform those services for Avoxa. Workspace-selected agent systems and webhooks receive the inputs and results you direct us to send.
We do not sell personal data or share it for cross-context behavioral advertising. The marketing website uses cookie-free visit counts from our hosting provider (no session replay); no payment processor or online checkout is currently integrated.
We may also disclose information when legally required, to protect rights or security, or in a corporate transaction with appropriate protections.
6. Storage, retention and deletion
Active account and test records are retained while needed to provide the workspace, unless removed through the service or an applicable retention setting. Production documents, recordings and backups use private object storage; the live database remains on application hosting. Access is restricted. No system is perfectly secure.
Account deletion removes your profile, sessions and personally owned workspace from the active database and queues its linked files for deletion. Shared workspaces owned by others remain; personal actor labels in their audit history are anonymized, and business records or content that must be kept by the workspace owner may remain under that owner’s responsibility. Reference documents and earlier versions remain restricted for up to 90 days for backup compatibility. Restricted database backups may contain historical data until they expire under the configured recovery-retention schedule. We retain backups only for disaster recovery, security and applicable legal obligations, and do not use them for normal product activity. Minimal private deletion receipts (account ID and deletion time, without email or content) are used to reapply deletion if a backup is restored. These receipts are kept only while old backup copies might still contain that account. Provider-controlled logs/records follow the provider’s applicable retention and legal obligations.
To delete your account, open Account & settings → Security in the dashboard and choose Delete my account. If you are waiting for access, use Delete my account on the waitlist screen. Confirm with your account email after stopping any active tests. For unavailable accounts or data outside your account, contact hello@avoxa.app; we verify identity/authority before acting. Where the law requires a response within a particular period, we follow that period.
7. International processing
Avoxa is a US-based business. Hosting, communications and AI providers may process data in the United States, Europe and other regions. Selecting a test region does not guarantee that every provider processes all data there. Where EU/UK transfer rules apply, the required safeguards, such as contractual transfer terms, must cover the relevant processing. Contact us for the applicable processing agreement and transfer arrangements before sending regulated data.
8. Your rights
Depending on your location and our role, you may request access, correction, deletion, restriction, objection or portability, and withdraw consent where processing relies on consent. You can contact hello@avoxa.app to exercise rights without discrimination. We may need to verify your identity. If we process data for a business customer, we may direct your request to that customer. You may also complain to your local data-protection authority, including an EU authority or the UK ICO.
The service is for business users aged 18 or older. We do not knowingly seek children’s personal data. Contact us if you believe a child has supplied data.
9. Cookies, browser storage and policy changes
The marketing website uses no cookies, advertising or session replay. Our hosting provider counts visits and measures page load times without cookies, local storage or an ID that identifies you. In the dashboard, avoxa_session is a sign-in cookie normally valid for up to 30 days; sidebar_state remembers the sidebar for up to seven days; avoxa-theme stores your appearance choice locally. Temporary session storage helps recover from failed application-asset loads. Browser controls let you clear this storage; clearing a sign-in cookie signs you out. Material policy changes will be communicated through the service or account email when appropriate. A policy update is not consent for a new optional use.
